1. Assumption of Risk & Voluntary Participation
I, the undersigned, acknowledge and fully understand that participation in martial arts activities at Guerilla MMA, including but not limited to grappling, kickboxing, striking, wrestling, and other forms of combat training, involves close physical contact and significant physical exertion, with inherent risks of injury, including serious injury, permanent disability, and even death.
I understand that these risks may arise from my own actions, the actions of others, or the condition of the premises or equipment used. I voluntarily and knowingly assume all risks associated with my participation in any and all activities at Guerilla MMA.
I certify that I am physically and mentally fit to participate in such activities and that I have no medical conditions that would increase the risks of injury.
2. Release of Liability
In consideration for being permitted to participate in activities at Guerilla MMA, I hereby release, discharge, and hold harmless Guerilla MMA, its owners, instructors, agents, employees, successors, and assigns, from any and all claims, demands, losses, or liabilities that may result from my participation. This waiver covers any and all claims arising out of ordinary negligence, including but not limited to claims for bodily injury, property damage, or wrongful death.
I acknowledge that this release applies to all risks, whether known or unknown, foreseeable or unforeseeable, and that it is binding on my heirs, executors, and assigns.
3. Gross Negligence and Willful Misconduct
I further agree that Guerilla MMA is not liable for any injuries or damages caused by gross negligence or willful misconduct unless otherwise mandated by law.
4. Indemnification Clause
I agree to indemnify and hold harmless Guerilla MMA, its owners, instructors, and employees from any and all claims, actions, or damages (including legal costs) resulting from my participation in activities or use of the facilities. This includes claims brought by third parties that arise from my own actions or negligence during participation.
5. Consent for Emergency Medical Treatment
In the event of an emergency, I consent to receive any necessary medical treatment, including but not limited to first aid, CPR, and emergency transport, at my own expense. I acknowledge that Guerilla MMA is not responsible for any medical expenses incurred as a result of injuries sustained during participation.
6. Medical Insurance
I certify that I have valid medical insurance to cover any injuries or medical treatment that may result from my participation in activities at Guerilla MMA. I agree to provide proof of such insurance when requested.
7. Photo and Media Release
I hereby grant Guerilla MMA permission to use my likeness in any photographs, videos, or other media taken during my participation for marketing, promotional, or educational purposes. I waive any right to compensation or ownership of such media.
8. Communicable Diseases
I understand that participation in group activities may expose me to communicable diseases. I acknowledge that Guerilla MMA cannot guarantee that participants will not be exposed to such risks, and I voluntarily assume these risks.
9. Code of Conduct
I acknowledge that Guerilla MMA has a Code of Conduct in place to ensure the safety, respect, and integrity of all members and athletes. I have received the Code of Conduct, and I agree to comply with all guidelines and rules therein. I understand that failure to comply with the Code of Conduct may result in my suspension or expulsion from participation without refund.
10. Parental Consent (For Participants Under 18)
I, the undersigned parent or legal guardian of the participant, consent to their participation in Guerilla MMA activities. I understand and assume all risks on behalf of my child and agree to all the terms and conditions stated in this waiver.
11. Governing Law
This waiver shall be governed by and construed in accordance with the laws of the state of North Carolina. Any disputes arising under this waiver shall be resolved exclusively in the courts of North Carolina.
12. Acknowledgment of Understanding
I have carefully read this waiver and fully understand its terms. I understand that by signing this document, I am waiving certain legal rights, including the right to sue Guerilla MMA. I certify that I am signing this agreement voluntarily and without any inducement or assurance of any kind.
